A Massachusetts condo board should contact its attorney promptly when a legal deadline, fair housing request, serious enforcement dispute, or uncertainty about board authority could affect its next step. For routine vendor, maintenance, and budgeting decisions, start with the manager or the appropriate technical professional. When the board needs legal advice, one designated contact can send a short factual timeline, the relevant documents, and a specific question.
Which issues should go to counsel?
- Time-sensitive notices and disputes. Forward a demand letter, bankruptcy notice, or potential claim deadline promptly. If an owner’s attorney contacts the board, coordinate the response through association counsel.
- Fair housing and serious enforcement. Seek timely advice on disability accommodation requests, assistance animals, and complaints that raise fair housing concerns. For a serious enforcement matter, ask about authority and required procedures before sending a formal notice.
- Injuries and claims. Follow the association’s incident reporting procedures and contact the insurer and counsel as appropriate.
- Unclear authority or unfamiliar transactions. Ask who can approve a document amendment, first special assessment, association loan, or management contract termination and which notices or votes are required.
For example, an engineer can explain whether a foundation drain has failed. Counsel can help determine who is responsible for it under the condominium documents. The board can use both answers to decide how to proceed.
What should the board send its attorney?
Give counsel enough information to answer in one pass. For a hallway enforcement question, attach the corridor rule, the enforcement provision, dated photos, and prior correspondence. Then ask whether the board may impose a fine under the cited provision and what notice or opportunity to respond is required.
Assign one board-authorized contact and agree on a spending threshold for further work. Ask the firm to confirm rates, staffing, billing increments, and any available flat fees for recurring matters. Budget for legal work and ask for written guidance when the board will need a reliable record. Have counsel advise on who can receive or discuss privileged material before circulating it.
Board checklist for contacting counsel
- Identify the decision and any deadline.
- Send a dated timeline and the relevant document sections.
- Ask a specific question and say when the answer is needed.
- Confirm who can authorize additional work.
- Ask how the advice should be recorded and shared.
